What penalties are envisioned for offences related to obstructing the electoral process?

Imprisonmentof 15 days – 3 months and a fine of 10,000–100,000 fr

Art. 128 : Any person whoparticipates in an electoral process with a visible weapon shall be punishedwith a fine of 50,000 to 120,000 francs.

If the weapon is hidden, the offendershall be punished with an imprisonment of fifteen days to three months and afine of 50,000 to 350,000 francs

(? Quiconque participe ? une consultation ?lectoraleavec une arme apparente sera passible d’une amende de cinquante mille ? centvingt mille francs CFA. 

La peine sera d’une emprisonnement de quinze jours ?trois mois et d’une amende de cinquante mille ? trois cent cinquante millefrancs CFA si l’arme ?tair cach?e.?)

Art. 129 : Any person who, throughmenacing gatherings, clamours or demonstrations, disrupts election operationsor infringes the exercise of the right to vote or the right to a free voteshall be punished with an imprisonment of six months to two years andprohibition of the right to vote and be elected for a period of five to tenyears.

(? Quiconque, par attroupements, clameurs oud?monstrations mena?antes, aura troubl? les op?rations d’une consultation?lectorale ou port? atteinte ? l’exercice du droit ?lectoral ou ? la libert? duvote, sera puni d’un emprisonnement de six (06) mois ? deux (02) ans et del’interdiction du droit de voter et d’?tre ?ligible pendant cinq (05) ans aumoins et dix (10) ans au plus. ?)

Art. 130 : Any person who violentlyattempts to break into or breaks into a polling station with a view to obstructan election, shall be punished with imprisonment of one to five years and afine of 300,000 to 600,000 francs.

If the offenders carry weapons or theelectoral process is violated, the penalty shall be imprisonment of five to tenyears.

(? Toute irruption dans un bureau de vote, consomm?eou tent?e avec violence, en vue d’emp?cher un choix, sera punie d’unemprisonnement d’un an ? cinq ans et d’une amende de 300.000 ? 600.000 francs CFA.
