What penalties are envisioned for offences related to unlawful conduct of campaign financing?

.      Article 178

.      (1)  For acts of preventing theelections and voting, violating and abusing the right to vote, violating thevoter’s freedom of choice, bribing during the elections and voting, destroyingelectoral documents and committing electoral fraud, shall be punished pursuantto the provisions of the Criminal Code.

.      (2)  For the criminal acts ofparagraph 1 of this article the procedure is urgent.

Article 165-a

(1) An organizer of election campaign whoby not reporting the source of the election campaign funding, by preventing thesupervision over the expenditure of planned funds, by not submitting report onthe funds spent, by violating the legal limitations for authorized funds forelection campaign, by using unauthorized funds for election campaign, bypayments contrary to the campaign for campaign funding or in other way abuseshis/her determined by law authorization as campaign organizer, will be punishedwith imprisonment of at least five years.  

(2)  The sentence prescribed in paragraph (1) of this article shall bepronounced for the responsible person with the legal entity who, by notreporting donations and other financing for an electoral campaign, bypreventing the supervision over financing or aiding in another way in anelection campaign, by not submitting financial statement or by giving false orincomplete data about given donations or other means, by violation of thelawful limitations regarding means allowed for election campaigns, by provisionof illicit means for election campaign, by payments opposite to the purpose offinancing the campaign or in another way abuses the authorizations prescribedby law.

Article 165- a (3) The person who, opposite to the limitationsprescribed by law, secretly donates an amount above the legal maximal amountfor another election campaign or one in which he/she participates,  
shall be subject to a fine 
or imprisonment of up to three years.
