55. Penalty forfailure as respects return or declarations.
Subject tosection 56, a candidate or election agent who fails to comply with therequirements of section 52 or 53 is guilty of an illegal practice.
55A.Investigation of returns
(1) Where theSupervisor of Elections is not satisfied that-
(a) a returnsubmitted under section 47 or 52 is a true return; or
(b) that areturn that should have been made under section 47 has been duly made, he maymake such investigations as are reasonably necessary for ascertaining theexpenses of the candidate in respect of whom the return is submitted.
(2) Any personwho, without reasonable excuse,fails to answer any question or produce anydocument reasonably required by the Supervisor of Elections for aninvestigation under this section is guilty of an offence and liable on summaryconviction to a fine of five hundred dollars or imprisonment for six months orboth.
(3) Anycandidate or election agent who contravenes subsection
(2) orknowingly makes any false statement in connection with an investigation carriedout under this section is guilty of an illegal practice.
56.Penalty forsitting or voting after failure to transmit return and declarations
Where, in thecase of any candidate, the return and declarations as to election expenses are not transmitted before the expiration of the time limited for thepurpose, that candidate failure shall not, after the expiration of that time,sit or vote in the House of Assembly asa member for the constituency for which the election was held until either the said return and declarations havebeen transmitted or until the date of allowance of an authorised excuse for thefailure to transmit the said return and declarations, and if he sits or votesin contravention of this subsection he is guilty of an offence and is liable onsummary conviction to a fineof one hundred dollars for every day or part thereof on which he sits or votes.
