PART VI MISCELLANEOUSPROVISIONS
Power to make regulations
74. (1) The Governor in Council may make regulations generally for giving effectto the provisions of this Act and without prejudice to such general power maymake regulations—
(a) with respect to the incurring of expenses and the making of payments byor on behalf of a candidate, whether before, during or after an election, onaccount or in respect of the conduct of such election;
(b) requiring the appointment of an election agent through or by whom allsuch expenses or payments as aforesaid shall be incurred or made;
(c) fixing the maximum amount of expenses and payments that may be incurredor paid, whether before, during or after an election, on account or in respectof the conduct of such election;
(d) fixing the time within which all election expenses shall be paid;
(e) requiring a return of election expenses and payments and prescribing theform in which the same shall be made and verified;
(f) prescribing the remuneration and travelling allowances and otherexpenses which may be paid to officers appointed under this Act;
(g) prescribing the duties ofreturning officers and the procedure to be followed in the performance of theirduties;
(h) adding to, rescinding, varying or amending any of the forms contained inthe Second Schedule; and
(i) prescribing penalties for the breach of any regulations made hereunder.
(2) Any regulationsmade under the provisions of subsection (1)
may, inspecifying any offence or offences, further specify that any such offence shallbe deemed to be an illegal practice.
(3) An election petitionmay be presented in respect of any illegal practice declared by suchregulations to be a ground for presenting such petition, and the provisions ofsections 52, 53, 56 and 57 shall, subject to such regulations, apply topetitions presented in respect of illegal practices.
Expenses of elections
75. All expenses properly incurred by, and all remuneration and travellingallowances payable to, officers under this Act shall be defrayed out of thegeneral revenue of Montserrat.
