PART V -MISCELLANEOUS

1. (1) Allexpenses on account of -

(a) holdingpublic meetings or organising any public display;

(b) issuingbills, placards, posters, pamphlet, circulars or advertisements;

or

(c) otherwisepresenting to the voters the candidate, the views

of thecandidate or of the political party which nominated

the candidate, witha view to promoting or procuring the election of the candidate shall beincurred by either the candidate, or an agent of the candidate appointed forthe purpose by the candidate in writing or a registered political party whichhas nominated the candidate and by no other person or body of persons.

(2) Where acandidate appoints an agent for the purpose of subsection (1), the candidateshall as soon as is practicable notify the Electoral Commissioner of theappointment.

(3) Thecandidate or an agent of the candidate or the registered

politicalparty, as the case may be, shall keep proper accounts of -

(a) all fundsreceived by the candidate, the agent of the candidate or the registeredpolitical party in connection with the election;

(b) allexpenses incurred by the candidate or the agent of the

candidate orthe registered political party under subsection

(1).

1. (1) A candidate,an agent of the candidate or a registered

politicalparty, as the case may be, who recieves any funds or incurs any expenditure inconnection with an election shall, within 45 days after the day on which theresult of the election is declared under section 38, prepare a statement of thefunds received and the expenses incurred by the candidate, agent of thecandidate or the political party, as the case may be.

(2) Thecandidate, the agent of the candidate or the registered

politicalparty, as the case may be, is not required to disclose

in thestatement prepared under subsection (1) -

(a) theidentity of the person or source who or which provided

the funds; and

(b) theidentity of the person in respect of whom the expenditure

was incurred.

(3) Within 60days after the day on which the result of an

election isdeclared under section 38, the candidate, the agent of

the candidateor the registered political party, as the case may be, shall deliver to theElectoral Commissioner a statement prepared under subsection (1) certified as atrue statement by the candidate, agent of the candidate or the registeredpolitical party.

(4) Where acandidate, agent of the candidate or the registered

political party-

(a) fails tocomply with subsection (3); or

(b) in astatement delivered under subsection (3), knowingly includes any incorrect or false particulars,

the candidate, agentof the candidate or the registered political party is guilty of an offence andis liable to imprisonment for 3 yearsand a fine of R20,000.
