The statute law (Miscellaneous Amendment Act No. 2 of 2002. Section 4A (1) of this Act states that registration of electors may be carried out at all times except in case of presidential elections between the date of commencement of 90 days period and date of such an election, in case of the election of the National Assembly between the date of the resolution of the parliament and date of such election and incase of a by-election between the date of declaration of the vacancy of the seat and the date of such a by-election.

Article 88(4) of the constitution of Kenya, 2010 provides that one of the mandates of the Independent Electoral and Boundaries Commission is the Continuous registration of citizens as voters. http://kenyalaw.org/kl/index.php?id=398

The Miscellaneous Amendment Act 2002 effected changes in the previous National Assembly and Presidential Act Cap 7 under the old constitution. This Act introduced continuous voter registration in Kenya in 2002. Before that voter registration was periodic. With the promulgation of the new constitution on 27th August 2010, continuous voter registration was anchored in the new constitution under Article 88.
