Article 4(m) of the  IEBC Act No.9 of 2011, states that the

The IEBC of Act, 2011 only states that the commission is responsible for the use of appropriate technology and approaches in the performance of its functions but it does not specify the kind of technology to be used nor the type of biometric data to be captured. This is left to the discretion of the IEBC to choose. Even if the IEBC captured both the fingerprint and voters photo, only the finger print was used for voters’ identification on the election day.
