Comment

Section 59 of Electoral Act, 1963 (last amended in 2015) provides for polling at elections. Section 70C provides for ‘special voters’ – a term meaning those absent from their constituency on the date of the election. But Section 70D only allows ‘special’ voting within Samoa:  “Despite anything to the contrary in this Act, a special voter may vote at such place within Samoa, at such time, in such manner, and upon or subject to such conditions as appear in this Act or are as may be prescribed in that behalf by regulations made under this Act.”
