Election of elected members
32.1 Kenya shall be divided into constituencies in accordance with section 42, and each constituency shall elect one elected member to the National Assembly in such manner as, subject to this Constitution, may be prescribed by or under any law.
The parliamentary elections operate on a first-past-the-post, single-member constituency system where voters elect one person per constituency by a simple majority. In 2005, a new Constitution was drafted to modify the electoral system. However, it was rejected by the electorate.
Following the violent conflict that immediately followed the 2007 elections, however, a new Constitution and electoral law was introduced again for further elections.
