PART XI

ELECTION PETITION

Section 39 Any applicant whose name doesnot appear as a candidate in the notice of

the Election Director ofconstituency under Section 37 shall have the right to file a motion

with the Supreme Court withinseven days as from the date of the notice of list of eligible

candidates, exempt from anyfee for the court proceedings. When the Supreme Court passes a

decision, it shall promptlyinform the Election Director of constituency and the election

director of the constituencyshall promptly comply with the court order. If the court orders the

acceptance of the application,the name of that person shall be notified under Section 37, but

it shall not affect any act done prior to thereceipt of the court order.
