ELECTION PETITION

Section 39 Any applicant whose name doesnot appear as a candidate in the notice of

the Election Director ofconstituency under Section 37 shall have the right to file a motion

with the Supreme Court withinseven days as from the date of the notice of list of eligible

candidates, exempt from anyfee for the court proceedings. When the Supreme Court passes a

decision, it shall promptlyinform the Election Director of constituency and the election

director of the constituencyshall promptly comply with the court order. If the court orders the

acceptance of the application,the name of that person shall be notified under Section 37, but

it shall not affect any act done prior to thereceipt of the court order.

Section 44 In the case where the name ofany person does not appear as a candidate in the list published by theElection Commission under Section 43, such person shall have the

right to file a motion withthe Supreme Court within seven days as from the date of the publication of the list ofcandidates for the election and the provisions of Section 39 shall apply mutatis mutandis.

Section 45 Prior to the election day, ifit appears that any candidate on a proportional basis does not have aqualification or is under a prohibition to stand for an election, the Election Commission shallforthwith proceed to an inquiry and investigation and the provisions of Section 40 shallapply mutatis mutandis
