The law does notrequire a hearing to take place always, it does say it may take place if thecase files were not delivered (art.30) or because the complexity of the disputeso require ( art.31,32, 34) or requires direct examination ( art.33). We havecoded as “No” because we didn’t understand it as a requirement but rather as atool available to judges to facilitate the dispute resolution process.
