NationalParliament Electoral Provisions Act [Cap 87]- [1996 EDITION], with reference to theNational Parliament Electoral Provisions (Amendment) Bill of 2010, 84
84 (1) Every election petition shall be heard by the Court in opencourt.
(2) During such hearing the Court may order—
(a) the inspection and production of any rejected ballot papers;or
(b) the opening of any sealed packet of counterfoils of usedballot papers; or
(c) the inspection of any counted ballot papers; or
(d) the inspection and production of tendered ballot papers andthe tendered votes list:
Provided that in making and carrying into effect the order madeunder this subsection care should be taken that the way in which the vote ofany particular elector has been given shall not be disclosed until it has beenproved that his vote was given and the
vote has been declared by the Court to be invalid.
(3) At the conclusion of the hearing, the Court shall determinewhether the member whose return or election is complained of or any other and whatperson, was duly returned or elected, or whether the election was void, andshall certify such
determination to the Governor-General and, upon such certificationbeing given, such determination shall be final and shall not be questioned inany proceedings, nor shall any appeal lie therefrom to any court; and theelection shall be confirmed, or a new election shall be held, as the case mayrequire, in accordance with such certificate:
Provided that where the Court finds that any candidate who hasbeen declared to be elected was not qualified or was disqualified at the timeof his election, the court shall determine the election to be void.
