Possibility to appeal

LAW on Election of Members ofthe National Assembly (LEMNA) and Amendments of Law on Election of Members ofthe National Assembly

Art. 42 (new)

Any candidacy or list ofcandidates of a political party that is rejected by the National Election Committee,that candidate or concerned political party shall have their right to appeal inwriting to the Constitutional Council within five (5) days after the date receiving therejection notice.

In the event of dissolution ofthe National Assembly before the end of its mandate, the candidate orconcerned political party may appeal in writing with the Constitutional Councilimmediately.

The Constitutional Councilshall examine and decide on the appeal within ten (10) days after the datereceiving the appeal.

In the event of dissolution ofthe National Assembly before the end of its mandate, the ConstitutionalCouncil shall immediately examine and decide on the appeal.

Art. 43

A hearing or a partial hearingconducted by the Constitutional Council to rule on the appeal shall be public. The Constitutional Councilshall post the date, place and time of the hearing on the appeal.

Art. 44

After the end of the period of political parties registration running inthe Election or/and afterthe final decision on all complaints and appeals , the National ElectionCommittee shall post the list of registered political parties running in theElection and their list of candidates for each province/municipality, inaccordance with the regulations and procedures.
