8.  Decision as to validity of nomination papers

(1) Where anomination paper and the candidate’s consent thereto are delivered and adeposit is made in accordance with these rules, the candidate shall be deemedto stand nominated unless and until the returning nomination, officer decidesthat the nomination paper is invalid or proof is given to the paperssatisfaction of the returning officer of the candidate’s death, or thecandidate withdraws.

(2) Thereturning officer shall be entitled to hold a nomination paper invalid on oneof the following grounds only:

(CZ) that theparticulars of the candidate or the person subscribing the paper are not asrequired by law;

(b) that thepaper is not subscribed as so required.

(3) Thereturning officer shall give his decision on any objection to a nominationpaper as soon as practicable after it is made.

(4) Where hedecides that a nomination paper is invalid, he shall endorse and sign on thepaper the fact and the reasons for his decision.

(5) Thedecision of the returning officer that a nomination paper is valid shall befinal and shall not be questioned in any proceeding whatsoever.

(6) Subject to paragraph (5),nothing in this rule shall prevent the validity of a nomination beingquestioned on an election petition lodged pursuant to the Election Offences andControversies Act.
