What remedies are available in the first instance?

Art. 133: In case anact of the President of the CENI issued under sections 156, 157 and 158 of thisCode is challenged, the representative of the list of candidates may, withintwenty-four hours from the notification or publication of the decision, file acomplaint before the Constitutional Court. The latter shall issue a decisionwithin the three days after the date the complaint was filed.

(? Encas de contestation d’un acte du Président de la CENI pris en application desarticles 156, 157 et 158 du pr?sent code, les mandataires des listes decandidats peuvent dans les vingt quatre (24) heures suivant la notification dela d?cision ou sa publication, saisir la cour constitutionnelle.

Art. 157 : Ifit appears that a nomination was submitted for a person which is ineligible orfalls under any other case of irregularity, the President of the CENI shallreject this candidacy within seven days from its submission and notify therejection to the candidate or his/her representative.

The candidate orhis/her representative may challenge this decision within three days before theConstitutional Court, which shall issue a decision within seven days from thereferral.

If the abovedeadline is not met by the President of the CENI, the nomination shall beaccepted.

However, this approvalcan be challenged by any other candidate or political party, if it found thatthis non-compliance with the deadline by the President of the CENI wasintentional, or if the omission or negligence of the President of the CENIresulted in admission of a candidate who does not meet one or more substantialrequirements.

Lecandidat ou son repr?sentant dispose de trois (3) jours pour attaquer lad?cision de rejet devant la Cour Constitutionnelle qui statue dans les sept (7)jours de sa saisine.

Sile d?lai mentionn? ? l’alin?a 1er n’est pas respect? par le Président de laCENI, la candidature doit ?tre re?ue.

Toutefois,cette r?ception peut ?tre d?nonc?e par un quelconque candidat ou parti politiques’il est relev? que ce non respect du d?lai par le Président de la CENI estd?lib?r? ou si l’oubli ou la n?gligence du Président de la CENI a eu pourcons?quence d’admettre une candidature ne remplissant pas une ou plusieurscondition substantielles. ?)

Art. 158 (3) &(4) : In case of disagreement with the list of candidates published, the mattercan be brought to the Constitutional Court by the interested parties withinforty-eight hours of the publication of the lists.

The ConstitutionalCourt shall decide within forty-eight hours after the petition is filed andshall, in any case, publish the final list of candidates by posting it on theregistries of the courts concerned.
