There is a decision of the ConstitutionalCourt (19 October 2009 n. 259) that states that theAdministrative Courts have no jurisdiction on those cases therefore the CentralNational Commission is the last instance body. In the19 October 2009 n. 259 decision, an administrative court filled apetition to the Constitutional Courtchallenging the constitutionality of the articles 23 and 82 of the DPR n. 361- 30 March 1957. The AdministrativeCourt claimed the articles were unconstitutional “for not providing the possibility to file acomplaint to administrative courts”. The Constitutional Court rejected theclaim but demanded a rapid intervention from Parliament on the matter.
