Electoral Act 2006, 94, 96, 102

 

94. An election petition maybe presented to the High Court by one or more of the following persons—

(b) aperson claiming to have had a right to be nominated as a candidate or elected at theelection to which the election petition relates;

 

96. Every election petitionshall be signed by the petitioner or by

all the petitioners if morethan one, and shall be presented not later

than thirty days after the date on which the result of the election to

which it relates is dulydeclared.

 

102. An electionpetition shall be tried and determined by the High Court in open court, within one hundred and eighty days of thepresentation of the election petition as provided under section ninety-seven:

Provided that where anelection petition is not tried and determined within the period specified inthis subsection due to a failure by the petitioner to actively prosecute thepetition, the High Court shall dismiss the petition for want of prosecution.
