Election Dispute Resolution

Article 258

(1) Bawaslu is entitled to solve Election disputes.

(2) Bawaslu has the power to delegate authority toProvincial Bawaslu, Regency/Municipal Panwaslu, District/Kecamatan Panwaslu,Field Election Supervisor, or Overseas Election Supervisor.

(3) Bawaslu shall investigate and decide Electiondisputes within 12 (twelve) days after receiving the report or finding.

 

 

 

Article 269 paragraph (2), (6), (8), (9), (11) Law No 8/2012 onLegislative Election

(2)   Submission of Election state administrative disputeslawsuits as referred to in paragraph (1) shall be conducted no later than 3(three) workdays after the issuance of the Bawaslu Decree.

(6)   The Appellate State Administrative Court shall examineand decide the outcome of suit as referred to in paragraph (1) in no longerthan 21 (twenty one) workdays after the suit is declared as complete.

(8)   The cassation as referred to in paragraph (7) shall befiled in no longer than 7 (seven) workdays after the issuance of the decisionof the Appellate State Administrative Court as referred to in paragraph (6).

(9)   The Supreme Court of the Republic of Indonesia shalldecide on the appeal for cassation as referred to in paragraph (7) in no longerthan 30 (thirty) workdays from the reception of the cassation. 

(11)KPU is obliged to follow-up thedecision of the Appellate State Administrative Court as referred to inparagraph (6) or the decision of the Supreme Court of the Republic of Indonesiaas referred to in paragraph (9) in no later than 7 (seven) workdays.
