Article 27
Decisions by the Authority on applications forcandidacy can be appealed, by the head of the list, one of its members, thelegal representative of the Party, or members of other candidate lists in thesame electoral constituency, before the territorially-competent Court of FirstInstance, and before the 'Tunis 1' Court of First Instance withregard to decisions by the Authority concerning candidate lists abroad, via awritten petition accompanied by supporting documents and evidence ofnotification to the Authority and the respondents, within three days of thedate of notification or posting of the decision. Appeals do not requirerepresentation by an attorney.
Article 28
The competent Court of First Instance considersappeals in accordance with the procedures provided for in articles 43, 46, 47,48 (last paragraph), 49 and 50 of the Tunisian Code of Civil and CommercialProcedure, and may allow pleading at certain times.
The Court decides on the case no later than three daysfrom the date of filing, and notifies the parties with the ruling no later than48 hours from the date of issuance and via any method with a written record.
Article 29
Rulings of the Courts of First Instance may beappealed before the Appellate Chambers of the Administrative Court by theparties involved in the ruling of First Instance or the President of theAuthority within three days of notification of the ruling, via a writtenpetition that is reasoned and accompanied by supporting documents, thenotification of appeal, and evidence of notification to the respondent via acourt bailiff, or else the appeal will be rejected.
Article 30
The secretariat of the court shall register thepetition and refer it immediately to the First President of the AdministrativeCourt who assigns it to an Appellate Circuit without delay.
The President of the competent Circuit shall schedulea pleading session no later than three days from the date of registration ofthe petition, and call the parties via any means with a written record topresent their remarks.
The Circuit shall refer the case to deliberation andpronouncement of the ruling within 48 hours of the date of the pleadingsession, and may authorize execution by marking the draft. The AdministrativeCourt is to advise the parties of the ruling via any means with a writtenrecord within 48 hours from the date of pronouncement.
The ruling shall be final and not subject to appeal byany means, including Cassation.
Article 31
Liststhat obtained a final court ruling are to be accepted, and the Authority is toannounce the finally accepted lists upon the expiration of appeals.
