12.
(6) If the Returning Officer disallows anyobjection, his decision shall be final and conclusive and shall not be calledin question in any court; but if he allows the objection, his decision shall besubject to reversal on an application under
section 71.
Application for avoidance of election on certain grounds
71. The election of a candidate asPresident shall be declared to be void on an application made to an ElectionJudge on any of the following grounds which may be proved to the satisfactionof the Election Judge:
(a)
that by reason of general bribery, general treating, or generalintimidation, or other misconduct, or other circumstances, whether similar tothose before enumerated or not, the majority of electors were or may have beenprevented from electing the candidate whom they preferred;
(b)
non-compliance with the provisions of this Act relating to elections, if itappears that the election was not conducted in accordance with the principleslaid down in those provisions and that the non-compliance affected the resultof the election;
(c)
that a corrupt practice or illegal practice was committed in connectionwith the election by the candidate or with his knowledge or consent or by anyagent of the candidate;
(d)
that the candidate personally engaged a person as his election agent, or asa canvasser or agent, knowing that the person had, within 7 years prior to suchengagement, been convicted or found guilty of a corrupt practice under this Actor the Parliamentary Elections Act (Cap. 218);
(e)
that the candidate was at the time of his election a person disqualifiedfor election as President.
