OSCE/ODIHRElection Assessment Mission Report Republic of Austria Presidential Elections25 April, 2010

Challenges to theresults of elections are made to the Constitutional Court, and must be filed within a four-weekperiod after the conclusion of the electoral process. The appeal will only begranted if the challenge is substantiated and the violation affected theoutcome of the election. Therefore, individual voters cannot have their caseconsidered on merits unless the infraction has affected the outcome. Thiscreates a situation whereby an individual voter may prove that his/herelectoral rights were violated and be denied an effective remedy. Constitutional Court decisionsare final; meaning that in these cases there is no possibility toappeal. No complaints were filed to the Constitutional Court contesting theresults of this year’s election.
