Power to make regulations
87. (1) The Governor in Council may make regulations generally for givingeffect to the provisions of this Act and, without prejudice to that generalpower, may make regulations—
(a) withrespect to the registration of voters;
(b) withrespect to the incurring of expenses and the making of payments by or on behalfof a candidate, whether before, during or after an election, on account or inrespect of the conduct of the election;
(c) requiringthe appointment of an election agent through or by whom the expenses or paymentsreferred to in paragraph (b) shall be incurred or made;
(d) fixing themaximum amount of expenses and payments that may be incurred or paid, whetherbefore, during or after an election, on account or in respect of the conduct ofthe election;
(e) fixing thetime within which all election expenses shall be paid;
(f) requiring areturn of election expenses and payments and prescribing the form in which theyshall be made and verified;
(g) prescribingthe remuneration and travelling allowances and other expenses that may be paidto officers appointed under this Act;
(h) prescribingthe duties of Returning Officers and the procedure to be followed in the performanceof their duties;
(i) adding to,amending or replacing the Forms set out in Schedule 2;
(j) prescribing penalties not exceeding $8,000for the breach of any regulation made under this Act; and
(k) prescribingany other matter that is to be prescribed by this Act.
(2) Aregulation made under subsection (1) may, in specifying any offence oroffences, further specify that the offence is an illegal practice.
(3) An electionpetition may be presented in respect of any illegal practice declared by the regulationsto be a ground for presenting such a petition, and the provisions of sections63, 64, 67 and 68 shall, subject to the regulations, apply to petitionspresented in respect of an illegal practice.
Expenses of elections
88. All expenses properly incurred by, and all remuneration and travellingallowances payable to, officers under this Act shall be defrayed out of thegeneral revenue of Anguilla.
