31. Punishment for makingexpenses in excess of specified
ceiling:
(1) If any person makesexpenses in excess of the ceiling specified by the Commission pursuant tosub-section (1) of Section 30 orfails to submit the returns of expenses within the period prescribed pursuantto sub-section (4) of the same Section, the Commission may punish such person with a fineof a sum which is equal to the election expenses made by such person or theceiling of expenses specified by the Commission, whichever is the higher.

(3) Prior to imposing a fine pursuant tosub-section (1) or making a decision pursuant to sub-section (2), theCommission shall provide the concerned person with a reasonable opportunity todefend him or herself.
