What institution(s) has the power to impose non-criminal sanctions for campaign finance infractions?

Article 1. (1) This Code establishesthe arrangements and procedure for conduct of elections of NationalRepresentatives, President and Vice President of the Republic, Members

of the European Parliamentfor the Republic of Bulgaria, municipal councillors, municipality mayors andmayoralty mayors, as well as the terms for electing National Representatives, aPresident and Vice President of the Republic, Members of the EuropeanParliament for the Republic of Bulgaria, municipal councillors, municipalitymayors and mayoralty mayors.

Financing Report

Article 159. (1) Within 30 days afterpolling day, the parties, the coalitions of parties and the nominationcommittees shall present a report in hard copy and in soft copy to theBulgarian

National Audit Office onthe financial resources raised and spent and the payment obligations assumedthereby in connection with the election campaign, accompanied by a statement ofthe

bank account thereof.

(2) The financial resourcesof the candidate and/or a member of the nomination committee for the electioncampaign shall be accounted for in the reports referred to in Paragraph (1). Adeclaration on origin of the financial resources shall be attached to the reportswhere the said resources are in an amount exceeding BGN 1,000.

(3) The reports referred toin Paragraph (1) shall be prepared and presented in a standard form for eachtype of election, endorsed by the Bulgarian National Audit Office.

(4) The Bulgarian NationalAudit Office shall publish the reports of the parties, coalitions of partiesand nomination committees referred to in Paragraph (1) within 15 days after theexpiry of the time limit for the presentation of the said reports.

(5) The Bulgarian NationalAudit Office shall verify the correspondence of the financial resources raisedas declared to the financial resources actually spent in connection with the

election campaign.

Breach of Requirements toCampaign Financing

Article 289. (1) Upon breach of therequirements to financing of the election campaign under Section VI of ChapterEight herein, the person who represents the party or the nomination committee,or the persons who represent the coalition of parties, shall be liable to afine of BGN 5,000 or exceeding this amount but not exceeding BGN 10,000.

(2) Any candidate formunicipal councillor or mayor, who has breached the requirements for raisingfinancial resources under Section VI of Chapter Eight herein, shall be liableto a fine

of BGN 5,000

Ascertainment of Violationsand Imposition of Sanctions by President of Bulgarian

National Audit Office

Article 301. (1) The written statementsestablishing the violations referred to in Article 289 herein shall be drawn upby officials empowered by the President of the Bulgarian National Audit Office.

(2) The penalty decreesshall be issued by the President of the Bulgarian National Audit Office.
