Trial of election petitions
67. (1) Every election petition shall be tried in the same manner as anyother action in the High Court by a Judge sitting alone.
(2) At theconclusion of the trial, the Judgeshall determine whether—
(a) the memberof the Assembly whose return or election is complained of or any, and what,other person was duly returned and elected; or
(b) theelection was void; and shall certify such determination to the Governor, and,upon his certificate being given, it is final and the return shall be confirmedor altered, or a writ for a new election issued, as the case may require, inaccordance with the determination.
(3) No electionshall be declared invalid by reason of the failure of the Governor or anyelection officer to comply with this Act or the regulations, or by reason ofany mistake made by any person in the use of the forms prescribed by or underthis Act, if it appears to the tribunal having cognizance of the question that theelection was conducted in accordance with the principles laid down in this Actand the regulations and that the failure or mistake did not affect the resultof the election.
