XIII. COMPLAINTS AND APPEALS
The complaintsand appeals process, primarily regulated by the election law, civil procedurecode, and administrative offences code, generally lacks sufficient clarity andguarantees of due process. Courts and election commissions have overlappingjurisdiction for consideration of complaints against decisions of electioncommissions, with theSupreme Court as a final instance in all cases. In this context, thereis a lack of clarity about the respective mandates of the courts and electoralbodies. This is made worse by an absence of systematic co-operation between thekinds of institutions in cases when duplicate complaints are filed. Complaintsalleging violations of the election law can be filed to courts.
