What remedies are available?

Article 417. After having reviewed thecassation appeal, cassation instance has the right to:

a)to dismiss the appeal and uphold the decision of the first instance

b)satisfy the appeal and change the decision taken by the first instance

c)satisfy the appeal, cancel the decision of the first instance and make a newdecision, without returning the case for a new hearing if there is no need foradditional check of the proofs submitted to the cassation instance if thecircumstances of the cases have been identified in the first instance, but thenorms of law have been wrongly applied to it.

d)satisfy the appeal. Cancel in full or in part the decision made in the firstinstance and return the case for an additional adjudication to the first instanceif the judicial mistake cannot be corrected in the cassation instance

e)satisfy the appeal, cancel the decision of the first instance and takejurisdiction if it is established that adjudication of the case in the first orcassation instance is within its jurisdiction

f) satisfy theappeal, cancel in full or in part the decision taken in the first instance andstop the adjudication of the case or leave the appeal without consideration ifthere are reasons provided in article 265 and 267
