Proceedings forinfringement of the rules of campaign financing

Article 67 (1) Amotion can be filed by a candidate for President of the Republic demand that the courtpursuant to other legislation 12 ) decided that there was a breach of therules of campaign financing under this Act by adopting funds or otherperformance realizable value in money, which is not or know the true origin,exceeded the limit on campaign expenditures or result in the breach of campaignfinance or accounting is disclosed under this Act, and in what way and to whatextent this obligation was breached.

(2) The proposal must be made ​​within 60 days from thedate on which the enabling remote access to the website published statement ofthe candidate's election campaign, or within 60 days after the lapse of thedeadline for its publication.

 

Article 68. Jurisdiction of the courts

The proceedings under ? 65 and 66 is bythe Supreme Administrative Court. Theproceedings under ? 67 of the competent Municipal Court in Prague.

 “Within 60 days of theannouncement of official results, a report on campaign accounting has to bepublished on the candidates’ websites and provided to the Mandate and ImmunityCommittee of the Senate. This committee is a depository body for the campaign financingreports, and has no mandate to scrutinize their accuracy. There are no otherinstitutions responsible for checking the accuracy of the reports, and nosanctions for incomplete reporting or failure to report.”

The election law limits the right to file complaints on theinfringements of campaign financing measure solely to candidates, giving thejurisdiction to rule on such complaints to the Municipal Court of Prague; its decisions can be appealed to theSupreme Administrative Court.
