Article 37. Responsibility for violation of theConstitutional Law of the Republic of Tajikistan “On Election of the Presidentof the Republic of Tajikistan”

In case of violation of the present Constitutional Law by a candidate tothe president of the republic, the Central Commission for Elections andReferenda shall warn the candidate, in case of repeat violation, it can cancelthe decision on registering the candidate to the post of the President of therepublic.
Complaints addressed to election commissions and government and publicbodies with regard to violation of the Constitutional law shall be consideredwithin three days, and on day of election – immediately.

X. COMPLAINTS AND APPEALS
The PEL provides for complaints and appeals against decisions ofelection commissions, as well as with regard to voter and candidateregistration. Decisions of election commissions may be appealed to either thehigher-level election commission or the courts, with the Supreme Court as thefinal instance. The OSCE/ODIHR has previously observed that this dual system ofelectoral dispute resolution could potentially lead to inconsistencies indecisions.
