Chapter 9

Article 43 Settlement of Disputes relating to Presidentialelection

Any dispute relating to the Presidential election shall be settledby the ConstitutionalCourt, court and/or General Election Committee within the jurisdiction and inaccordance with procedure, as prescribed by laws.

There is no clear reference in the law abouthow the appeal processes work when the sanctions related to campaign financeare appealed by candidates or parties. OSCE/ODIHR Election Observation MissionFinal Report Presidential Election Mongolia (2013-06-26) also recommended that “In order to enhance transparency andpublic confidence in the integrity of the campaign finance, the GEC shouldpublish campaign finance regulations in a timely manner and effectively enforceoperable and transparent campaign finance oversight procedures, including inthe pre-election period.
