Article 19. Reviewing of complaint withregard to the decisions of election commission

Claims on decisions of election commissionshall be filed to the upper election commission or to court within 10 days fromthe day of adoption.

On decision of the Central Commission forElections and Referenda claims can be filed to the Supreme Court of theRepublic of Tajikistan within 10 days of their adoption. Claims shall besubject to consideration within three days and in case if there are less thansix days before election, claims shall be considered immediately.

 

 

Article 37. Responsibility for violation of theConstitutional Law of the Republic of Tajikistan “On Election of the Presidentof the Republic of Tajikistan”

In case of violation of the present Constitutional Law by a candidate tothe president of the republic, the Central Commission for Elections andReferenda shall warn the candidate, in case of repeat violation, it can cancelthe decision on registering the candidate to the post of the President of therepublic.

 

Complaints addressed to election commissions and government and publicbodies with regard to violation of the Constitutional law shall be consideredwithin three days, and on day of election – immediately.
