Article 38 (항고)
(1) 당사자와 검사는 과태료 재판에 대하여 즉시항고를할 수 있다. 이 경우 항고는 집행정지의 효력이 있다.
Article 40 (항고의 절차)
「민사소송법」의 항고에 관한 규정은 특별한 규정이 있는 경우를 제외하고는 이 법에 따른 항고에준용한다.
Comment
Although notexplicitly specified in the Administrative Regulations on Political Funds, it isimplied by its Article 44.4 that procedures outlined in the Law onAdministrative Penalties are to be followed in the case of an appeal.
